These Terms of Service (the “Terms”) govern your use of americanvtwinparts.com and any purchase from American V Twin (collectively, the “Services”). By using the Services or placing an order, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility and account information

You must be at least the age of majority in your state of residence to place an order. You agree to provide accurate, current, and complete account, billing, payment, and shipping information. You are responsible for maintaining the security of your account credentials and for activity under your account.

2. Products, descriptions, and fitment

We work to present accurate product descriptions, images, pricing, availability, and fitment information, but manufacturer and supplier data can change or contain errors. Colors and appearance may vary by device. We may correct errors, update information, limit quantities, or discontinue products without prior notice.

Vehicle fitment depends on the specific year, make, model, trim, configuration, and prior modifications. You are responsible for verifying fitment and compatibility before installation. Contact us before purchase if you are uncertain. Installation, diagnosis, tuning, and safety-critical work should be performed by a qualified professional.

3. Orders and acceptance

Your order is an offer to purchase. An order confirmation only acknowledges receipt and does not guarantee acceptance or availability. We may accept, decline, limit, or cancel an order, including for pricing errors, suspected fraud, supplier unavailability, shipping restrictions, or other legitimate business reasons. If we cancel after payment, we will issue a prompt refund to the original payment method.

Cancellation requests are governed by our Return and Refund Policy. Requests made within one hour are reviewed but are not guaranteed. Special orders are non-cancellable after the supplier order has been submitted.

4. Prices, payment, and taxes

Prices and promotions may change without notice. The price charged is the price shown when the order is submitted, subject to correction of an obvious error. Applicable taxes, shipping, handling, and other disclosed charges are added at checkout. You represent that you are authorized to use the payment method provided and agree to pay all approved charges.

5. Shipping and delivery

Shipping destinations, processing times, charges, tracking, damage reporting, and delivery estimates are governed by our Shipping Policy. Delivery times are estimates unless expressly stated otherwise. Nothing in these Terms limits rights or remedies provided by applicable law for delayed, lost, or damaged shipments.

6. Returns, refunds, and final-sale items

Returns, restocking fees, cancellations, shipping damage, shortages, final-sale items, and refunds are governed by our Return and Refund Policy. Review that policy before ordering. Final-sale restrictions do not eliminate rights required by applicable law or a valid manufacturer warranty claim for a verified defect.

7. Manufacturer warranties

Unless American V Twin expressly provides a separate written warranty, product warranties are provided only by the applicable manufacturer and are subject to that manufacturer's current terms, exclusions, procedures, and remedies. A warranty claim may require proof of purchase, troubleshooting, inspection, photos, an RMA, or return of the product. Approved remedies may include repair, replacement, a refurbished replacement, or a comparable model rather than a refund.

Improper installation, misuse, abuse, overpowering, incorrect impedance, clipping, modification, unauthorized repair, accident, neglect, or poor return packaging may void warranty coverage. Removal, reinstallation, labor, tuning, diagnostic, and shipping costs are not automatically covered unless the manufacturer, American V Twin, or applicable law requires coverage.

8. Intellectual property

The Services and their original content, design, graphics, logos, text, images, and other materials are owned by or licensed to American V Twin and are protected by applicable intellectual property laws. You may use the Services for personal, non-commercial purposes only. You may not reproduce, distribute, modify, scrape, republish, or commercially exploit the Services without prior written permission, except as allowed by law.

9. Third-party services and Shopify

The Services may include links, tools, content, or functionality provided by third parties. Your use of third-party services is subject to their terms and is at your discretion. American V Twin is powered by Shopify, but sales made through this store are transactions directly between you and American V Twin. Shopify is not the seller of the products offered by American V Twin.

10. Prohibited use

You may not use the Services unlawfully; infringe another person's rights; submit false or harmful information; transmit malware; interfere with security or operation; attempt unauthorized access; impersonate another person; harvest personal information; or use automated methods in a manner that violates posted restrictions or applicable law. We may suspend or terminate access for a material violation.

11. Disclaimer of warranties

To the fullest extent permitted by law, and except for any express written warranty or non-waivable legal right, the Services are provided “as is” and “as available.” We do not warrant that access will always be uninterrupted, secure, or error-free. Product warranties, where available, are governed by the manufacturer terms described above. Some jurisdictions do not allow certain exclusions, so those exclusions may not apply to you.

12. Limitation of liability

To the fullest extent permitted by law, American V Twin and its owners, employees, affiliates, agents, contractors, and service providers will not be liable for indirect, incidental, special, punitive, or consequential damages arising from the Services or a product purchased through them. Any direct liability will not exceed the amount paid for the product or service giving rise to the claim, except where applicable law does not allow that limitation. Nothing in these Terms excludes liability that cannot legally be excluded.

13. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless American V Twin and its affiliates, owners, employees, and service providers from third-party claims, losses, or reasonable expenses arising from your unlawful use of the Services, violation of these Terms, or infringement of another person's rights.

14. Governing law

These Terms are governed by the laws of the State of Florida and applicable federal law, without regard to conflict-of-law rules. Subject to any non-waivable consumer right, disputes will be brought in the state or federal courts serving Palm Beach County, Florida.

15. Changes, severability, and entire agreement

We may update these Terms by posting a revised version and effective date. Material changes apply prospectively as required by law. If a provision is found unenforceable, the remaining provisions remain effective. These Terms and the policies linked above form the agreement between you and American V Twin concerning the Services.
